Following the last meeting of the Interministerial Regulatory Board for Foreign Trade in Defence and Dual-Use Material (JIMDDU), the document of interpretative criteria that we already addressed last October has been updated, incorporating a more detailed explanation on the application of temporary global licences.
Regulatory context
Article 23 of Royal Decree 679/2014, of 1 August, approving the Regulation on the control of foreign trade in defence material, other material and dual-use goods and technologies, regulates the Global Transfer Licence for this type of material. However, unlike what happens with individual licences – for which Article 22.2 does expressly contemplate the possibility of temporary licences – the Regulation does not expressly provide for the figure of the temporary global licence.
